Jay-Z’s Strategy to Deal With Alleged Rape Case
Influential rapper and businessman, Shawn Corey Carter, know professionally as Jay-Z has been embroiled in a high-profile rape case.
His legal team has now revealed their defense strategy, accentuating factual rebuttals and procedural integrity.
The woman whose identity remains anonymous, alleged that the rapper raped her at an afterparty for the 2000 MTV Video Music Awards. She claims to have just been 13 years old.
These accusations came to light only recently, and have garnered the attention of fans and critics alike, since it was publicized.
Alex Spiro And The Legal Team’s Approach
Alex Spiro, the attorney who represents the rap mogul filed a pre-motion earlier this week. According to him, the lawsuit which alleged that Jay-Z raped a minor in 2000 could not go on because the incident was too old.
Additionally, Jay and Spiro are pushing for the dismissal of the case, questioning the validity of the allegation. Spiro’s argument stems from the fact that the claims do not fall under the Victims of Gender-Motivated Violence Protection Act.
He maintained that the law which was implemented in December 2000 was not retroactive. This means that it cannot apply to incidents that happened before it was enacted. The rape had allegedly happened in September 2000, three months before the law was passed.
In a pre-hearing letter, Spiro asserts that retroactive application of the law would be unconstitutional. He believes it would infringe upon both state and federal rights, potentially leading to unjust outcomes.
Furthermore, Spiro disputes the relevance of the law, by accentuating the jurisdictional limitations. He asserts that the statute only applies within New York City, whereas the party took place outside its boundaries.
Judge Torres Disapproves Legal Team’s Request
Judge Torres has expressed disapproval of Jay-Z and Spiro’s request to fast-track the dismissal proceedings.
“Carter’s lawyer’s relentless filing of combative motions containing inflammatory language and ad hominem attacks is inappropriate, a waste of judicial resources, and a tactic unlikely to benefit his client,” Judge Analisa Torres said, last week. “The Court will not fast-track the judicial process merely because counsel demands it.”
Besides defending the lawsuit filed by Jane Doe, Jay-Z and Spiro have been at loggerheads with her attorney, Tony Buzbee.
“My lawyer received a blackmail attempt, called a demand letter, from a ‘lawyer’ named Tony Buzbee,” Jay-Z had said in a statement.
“What he had calculated was the nature of these allegations and the public scrutiny would make me want to settle. No sir, it had the opposite effect! It made me want to expose you for the fraud you are in a VERY public fashion. So no, I will not give you ONE RED PENNY!”
The lawsuit has attracted widespread attention for igniting discussions on social accountability in sensitive matters.
